I always believed HIPs were going to be very bad news for house buyers, house sellers and expensively-trained Home Inspectors. I set out to stop this law before it started. On April 18th the House of Commons got a chance to hear me spell out details of my "Housing Act 2004 Amendment Bill”. This was a serious proposal to alter the existing law by repealing those sections which refer to Home Information Packs. But my Bill was introduced under the Ten Minute Rule and was steamrollered into oblivion by the Government. You can read it, for what its worth, by clicking here
Sadly HIPs survive. But only just. The new law is patently silly and is being treated with the disrespect it deserves. Houses with only three bedrooms do not need a HIP at all. Houses with four bedrooms can avoid the HIP by describing bedroom number 4 as a study and removing the bed. If you sell your house privately you can escape without a HIP.
The evidence of surveys by the Law Society and the Royal Institution of Chartered Surveyors suggests that HIPs are unpopular with buyers and sellers alike. And the maximum fine for failing to get one is less than the cost of having a HIP produced! Thus the Government is making law-breaking popular! This is a daft situation.
